Your privacy is valued at Climate Club Holdings PBC (“Climate Club”, “we”, “our”, “us”). This Climate Club Privacy Policy (the “Privacy Policy”) describes the types of information that we may collect from you (“you,” or “your”) or about you, when you use our website (“https://climateclub.com”), platform and services (collectively the “Services”), and how we use, disclose, and protected that information.
This Privacy Policy is incorporated by reference into the Climate Club Terms of Service (the “Terms”). Please read this Privacy Policy and our Terms carefully before accessing or using our Services. Capitalized terms not defined in the Privacy Policy shall have the meaning set forth in the Terms.
We collect content and other information you provide when you use our Services, including registration and account information, profile details, ratings and reviews, and customer support requests. We may also collect information about other people that you provide to us.
If you make purchases through our Services, we may collect your full name, address, credit card /debit card or bank account information and any other information required to process your request.
We collect information about how you use our Services, such as the types of content you view or engage with, the frequency and duration of your activities, and your purchasing history. Climate Club may also collect information using cookies or other online tracking technologies as described in our Cookies Policy, available here.
We may receive information about you and your activities from third parties, including your employer if we contract with them, Business Partners who you interact with through our Services, partnering programs related to climate health you sign-up for, payment and delivery of membership services from our service providers, and information from third parties such as advertising networks, analytics providers, search information providers, and credit reference agencies.
Our Services includes social media features, such as the “Like” button and widgets such as the “Share This” button or other interactive features that run on our Services. These features may collect your IP address, which page you are visiting on our Services, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our Services. Your interactions with these features are governed by the privacy policy of the company providing the feature.
We collect information which may include Personal Information, statistical data such as Aggregated Information, Public Information and Sensitive Information.
“Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked to, directly or indirectly, a particular consumer or household. Personal Information does not include Aggregated or anonymized Information.
“Aggregated Information” (or “Aggregated data”) means that information is only viewable in groups and as part of a summary, not per the individual. Aggregate data is not Personal Information as personal identities have been removed and is not linked or reasonably likely to link any one individual or household.
“Public Information” means information that is publicly available through public records and/or through government entities.
You may choose to provide Personal Information on your account that falls under a special category of Personal Information called Sensitive Information. Sensitive Information has a heightened protection under certain privacy laws that may apply to you. Such information includes your racial or ethnic background, political views, sexual orientation, religious views, and health. We only collect Sensitive Information with your express consent.
The following table contains the categories (with non-exhaustive examples) of Personal Information and Sensitive Information we may collect about. We reserve the right to use and disclose Personal Information to comply with our legal obligations, and to protect and enforce our rights.
We use Personal Information to fulfill our service commitments to you, such as creating and maintaining accounts, providing support, account updates and suggestions, and managing purchases. We are able to deliver our personalized content and make suggestions for you by using the Personal Information to understand how you use and interact with our Services and Business Partners and the people or things you’re connected to and interested in on and off our Services. We may provide Personal Information to our Business Partners when you interact with them through our Services in order for you to receive tailored Services. We may also provide our Services to your employer; in which case we may provide your Personal Information to them in order to fulfill our obligations to them.
We use Personal Information to conduct surveys and research, develop new products and features, test those products and features in development, improve the effectiveness of our Services and marketing efforts, and conduct audits and troubleshooting activities. We use Personal Information that we receive from third parties to enhance our ability to serve you and to tailor our Services to you.
We use Personal Information to diagnose technical issues, conduct audits, and monitor our Services, including unauthorized or illegal use and fraud prevention. In doing so we will protect the rights, safety, and information of our members, third parties, as well as our own.
We may be required by law to disclose certain Personal Information when it is necessary to conform to legal requirements or comply with legal process. We may also use your Personal Information to protect our intellectual property and enforce our Terms.
We use Personal Information to facilitate payment transactions and manage purchases through our Services.
We use Personal Information to advertise and market our Services and those of our Business Partners, including to: present targeted advertising, send or provide you with advertisements, promotions and offers; analyze whether our advertisements, promotions, and offers are effective; and help us determine whether you may be interested in new products or services.
We may disclose your Personal Information in connection with a substantial corporate transaction, such as the sale of our business, a divestiture, merger, consolidation, or asset sale, or in the unlikely event of bankruptcy.
We use your Personal Information and Sensitive Information for any purpose described when you provide your Personal Information with your consent, which can be withdrawn at any time. If we need to use your Personal Information for other purposes, we will ask your permission first, including your express consent when we use your Sensitive Information.
To the extent that our processing of your Personal Information is subject to certain privacy laws, Climate Club processes Personal Information on the following legal bases:
When you create a Climate Club Account, you provide Account Information which is required for you to agree and accept our Terms of Service. Our Terms of Service is a contract between you and Climate Club, and we process that Account information and any additional Personal Information on the basis of performing that contract. We may also process your username and email address on other legal bases, as described below. If you have an employer sponsored Account with us, we may collect and process additional Personal and Payment Information on the basis of performing that contract. When you purchase products or services on our marketplace, we process Personal Information in order to perform the contract that applies to those services.
We rely on your consent to use your Personal Information under the following circumstances: when you fill out the information in your user profile; when you decide to participate in any research project, beta program, or survey; and for marketing purposes, where applicable. We may also rely on your consent when you interact with our Business Partners or participate in Business Partner’s programs through our Services. Our Services are based on tailoring our products to you, but that Personal Information is entirely optional, and you have the ability to access, modify, and delete it at any time. You may also withdraw your consent at any time.
Generally, the remainder of the processing of Personal Information we perform is necessary for the purposes of our legitimate interest, for example, for legal compliance purposes, security purposes, or to maintain ongoing confidentiality, integrity, availability, and resilience of Climate Club’s systems, Website, and Services.
Climate Club will share your Personal Information with its employees, agents, and affiliates who are authorized by Climate Club to access it, and for the purpose of providing you with the Services or as required by law.
We work with our partnering employers who wish to further mitigate their carbon footprint. They may provide your Account with additional benefits, such as purchasing funds. We share information with partnering employers to help manage and further their climate strategies. In such cases, we will only share your Personal Information with the partnering employers that you have a preexisting relationship with.
We may collaborate with other organizations to further our mission or partner with businesses who share the same values. In these cases, we may share your name, contact information and other details you provided when making an account, and we may share Personal Information that is relevant in order to tailor our Services to you. When you purchase products or services through the marketplace, we may share your Personal Information with our Business Partners in order to provide and tailor the services to you. We may also combine your Personal Information with other information we collected to provide and improve our Services including its products, content, and advertising. Additionally, we may need to share certain Personal Information to provide the Services, such as fulfilling purchase requests.
We work with a wide range of third-party services providers who help provide and make the Services accessible. These include contractors, system integrators, auditors, and others. Climate Club and our service providers may share your information with each other and use it consistent with this Privacy Policy. We may share your Personal Information with such service providers, so long as those parties agree to keep your Personal Information confidential.
We participate in behavioral-based advertising, which means that a third party may use technology, such as a cookie, to collect information about your use of our Services so that we can provide advertising about goods and services tailored to your interests. Some of these third-party providers may be able to collect Personal Information that you share via our Services to send marketing messages directly to you. The Personal Information collected by these third-party providers may include your device’s IP address, username, email addresses (where hashed or otherwise rendered pseudonymous) and other user and device-level pseudonymous information. Please keep in mind that your browser settings may not permit you to control the technologies utilized by these third-party companies.
Please remember that any information you share in public areas of our Services, such as on message boards, feedback sections or reviews, becomes public and anyone may take and use that information. Please be careful about what you disclose in these portions of our Services and do not post any Personal Information that you expect to keep private.
We will not sell your Personal Data to third parties for their use without your consent.
We take reasonable technical and organizational measures to protect the confidentiality, security, and integrity of your Personal Information. Although we use security measures to help protect your Personal Information against loss, misuse, or unauthorized disclosure, we cannot guarantee the security of information transmitted to us over the Internet. While we strive to use commercially acceptable means to protect your Personal Information, including aggregating and anonymizing information, there is no guarantee that information may not be accessed, disclosed, altered, or destroyed.
The Personal Information is stored on servers located in the United States We will retain your information for as long as needed to provide you with our Services, and as necessary to comply with our legal obligations.
We rely on you to update and correct the Personal Information contained on your Account. However, if you are unable to do so, or you wish to have your Personal Information, corrected, please follow the Contact Us method below.
You may request access to your Personal Information by contacting us as through the Contact Us method below. We will grant you reasonable access to the Personal Information that we have about you as required by law.
You may request that we delete your Personal Information by contacting us through the Contact Us method below. We will grant a request to delete Personal Information as required by law, but you should note that in many situations we must keep certain Personal Information to comply with our legal obligations, resolve disputes, enforce our agreements, or for other required business or legal purposes. Except as provided above, we will delete, aggregate, or de-identify all your Personal Information upon request, within the timeframes required by law.
We participate in behavioral-based advertising also known as Cross-context behavioral advertising, which allows us to provide you with personalized ads, products or services. If you wish to limit third parties’ collection of information about your use of our Services, you can opt-out of such marketing at here [____] or through the Digital Advertising Alliance or Network Advertising Initiative. Please note that opting out of behavioral advertising does not mean that you will not receive advertisements while using our Services. It will, however, exclude you from interest-based advertising conducted through participating networks, as provided by their policies and choice mechanisms.
You may opt-out of future marketing emails by following the unsubscribe instructions provided to you. Please note that if you have an Account, we reserve the right to send you certain communications related to our Services updates, your Account or your use of the Services, and these transactional messages may be unaffected if you choose to opt-out of marketing communications.
Some web browsers and devices permit you to broadcast a preference that you not be "tracked" online. At this time, we do not modify your experience based upon whether such a signal is broadcast.
California's "Shine the Light" law (Civil Code Section § 1798.83) permits individuals with whom we have a business relationship who are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. The California Consumer Privacy Act of 2018 ("CCPA") provides several rights to California residents with regards to the collection, disclosure, sale, and deletion of their Personal Data. If you have questions about exercising your CCPA Rights, please email us at consumersupport@climateclub.com with your name, postal address, telephone number, and email address with "California Consumer Privacy Rights" in the subject line.
Under the CCPA, a business that sells California residents' personal information to others: 1) must give notice to California residents before selling their personal information to others; and 2) must provide the right to opt out of the sale of their personal information. Climate Club does not sell personal information, including personal information of anyone under 16 years old. Thus, these notification and opt-out requirements do not apply to Climate Club. In accordance with California law, minors under the age of 18 residing in California may remove or request and obtain removal of content and information that they post on a website or other web-based apps. In order to remove or to request and obtain removal of such content and information, you may alert us at consumersupport@climateclub.com so that we may take appropriate action. You should be aware that removal of the content and information posted by a minor does not ensure complete or comprehensive removal of the content or information posted on our Services.
Our Services are not directed to children under the age of 18; if you are not 18 years or older, do not use our Services. We do not knowingly collect Personal Information from children under the age of 18 unless a parent has consented to it. If we learn that Personal Information of persons less than 18 years-of-age has been collected through our Services, we will take the appropriate steps to delete that information. If you are a parent or guardian and discover that your child or a minor under the age of 18 has posted, submitted, or otherwise communicated Personal Information to our Services without your consent, then you may alert us at support@climateclub.com so that we may take appropriate action to remove the minor's Personal Information from our systems.
If you are located in another jurisdiction, you should be aware that once your Personal Information is submitted through our Services, it will be transferred to our servers in the United States. By using our Services, or providing us with any Personal Information, you consent to the transfer, processing and storage of your Personal Information in the United States, a jurisdiction in which the privacy laws may not be as comprehensive as those in the country where you reside, and that the United States currently does not have uniform data protection laws in place.
We use cookies to collect statistical information about the ways you use our Services including which pages you visit, which links you use, and how long you stay on each page. Climate Club may also use cookies to create a database of your previous choices and preferences, saving you time and effort. When you first access our Services, you will receive a message advising you that cookies are in use. By continuing to browse the service, you agree to our use of cookies as described in the Cookies Policy. We may also permit select third parties to use cookies to collect information about our people’s online activities across other websites or over time to assist us with advertising or analytics. The use of cookies by third parties is not covered by our privacy policy, as we do not have access to or control over their cookies.

Climate club is not responsible for the terms of use, privacy policies or practices of any third-party including websites or services directly linked to our Services. We encourage you to review the privacy policies of any third-party site that you link from our service.
We reserve the right to update this Privacy Policy at any time, without prior notice to you, and any changes will become effective immediately upon posting. If we make material changes to this privacy policy, we will notify you by e-mail via the primary e-mail address specified in your Account or through a notice on the website home page. You are responsible for ensuring we have an up-to-date, active, and deliverable e-mail address for you or if you do not have an Account, for periodically visiting our website and this privacy policy to check for any changes. Your continued use of our Services following posting of any Privacy Policy changes constitutes your acceptance of such changes. The effective date of this Privacy Policy, and the last revised date is identified at the bottom of the page.

We try to respond to all legitimate requests within 30 days of your request. Occasionally it may take us longer and, in such cases, we will notify you of the delay, and may continue to update you regarding the progress of our response.
You will not be subject to discrimination as a result of exercising your rights described in this Privacy Policy. In some cases, when you exercise one of your rights, we may be unable to comply with the request due to legal obligations or otherwise, or we may be unable to provide you with certain products or services. These responses are not discrimination and our reasons for declining your request or ceasing services will be provided at that time.
